HAGB and German Citizenship: Why Turkey's Clean Slate Judgment Is Not as Clean as It Looks

Since the June 2024 reform of Germany's Citizenship Act, Turkish nationals can obtain German citizenship without giving up their Turkish passport. For the first time, becoming a German citizen no longer means choosing between two national identities.

But there is a problem that catches many applicants off guard: HAGB. Many people believe it is harmless because it does not appear in the standard criminal record after probation. The problem is that German naturalisation authorities usually ask for the archive record.

What Is HAGB?

HAGB (Hükmün Açıklanmasının Geri Bırakılması) is a mechanism in Article 231 of the Turkish Code of Criminal Procedure (CMK). It translates roughly as deferral of the announcement of the judgment.

After a full trial, the court concludes that the defendant committed the offence. Rather than officially announcing the verdict, the court defers it. A probation period (denetim süresi) of 3 to 5 years begins. If the defendant completes this period without committing a new offence, the case is dropped. The judgment is treated as though it never existed.

HAGB is common in cases involving assault, insult, minor property offences, and similar matters. It is excluded for certain serious categories.

The Two-Record Problem: Adli Sicil vs. Arşiv Kaydı

This is the core of the issue.

The Standard Adli Sicil

The adli sicil is Turkey's standard criminal record certificate. After a successful HAGB probation period ends, no entry appears there. Someone who checks only the standard record may conclude: no problem.

The Arşiv Kaydı

The arşiv kaydı is the comprehensive historical extract. It contains:

  • completed HAGB entries
  • discontinued and dropped proceedings
  • former convictions deleted from the standard record
  • other historical entries no longer in the standard certificate
  • German naturalisation authorities generally request the arşiv kaydı. The common assumption that "HAGB leaves no record" is therefore not accurate for naturalisation purposes.

    HAGB Under German Naturalisation Law

    German naturalisation under § 10 StAG requires that the applicant has not been convicted of a criminal offence. Section 12a StAG provides thresholds for minor convictions that can be disregarded.

    Active HAGB

    A pending HAGB is treated as an ongoing criminal matter. The naturalisation authority will typically suspend processing until the proceedings are concluded, or refuse the application if the underlying conduct is serious enough.

    Completed HAGB

    The judgment is formally annulled, but the authority sees the entry in the arşiv kaydı. The assessment depends on:

  • the nature of the offence
  • the severity of the conduct
  • how much time has elapsed
  • the overall picture of the applicant
  • There is no automatic rule. Some completed HAGB entries are disregarded. Others result in refusal or suspension.

    The 2024 Reform: More Applicants, Same Rules

    The June 2024 StAG reform introduced dual nationality for Turkish nationals applying for German citizenship.

    What changed:

  • dual nationality is now available
  • significantly more applications are being filed
  • What did not change:

  • criminal record requirements under § 10 and § 12a StAG
  • the practice of requesting the arşiv kaydı
  • assessment of HAGB entries
  • Your Strategic Options

    Option 1 — Wait Until Probation Is Complete

    If your HAGB is still active, wait until the denetim süresi ends. Then obtain both records and have them reviewed before filing.

    Option 2 — Accelerate the Turkish Proceedings

    In some cases, it may be possible to bring the Turkish proceedings to a faster conclusion. A Turkish criminal defence lawyer can assess options in your specific case.

    Option 3 — Withdraw HAGB Consent and Seek an Acquittal

    HAGB requires your explicit consent. In certain circumstances, it can be strategically better to withdraw that consent and continue proceedings with the goal of obtaining an acquittal. This only makes sense where the evidence genuinely supports it.

    Option 4 — Apply Transparently With Preparation

    If you have a completed HAGB in your arşiv kaydı and want to apply now, do not conceal it. Prepare a clear explanation of the underlying matter, the clean completion of probation, and your record since.
