You are living in Germany. Then something happens: you get stopped at Istanbul airport, or a message arrives telling you there is a criminal investigation in Turkey with your name on it. Maybe your number appeared in someone else's phone records. Maybe you were arrested, released and left Turkey without realising the case was still open.

Turkey has strict drug laws. A drug trafficking charge under TCK Art. 188 carries a minimum of ten years in prison. This is not an administrative fine you can ignore. It is a criminal proceeding that can follow you across borders.

Turkish Drug Law Basics: TCK Art. 188 and 191

TCK Art. 188 - Drug Trafficking: Manufacturing, importing, exporting, selling, handing over, transporting, storing or possessing drugs without authorisation.

TCK Art. 191 - Personal Use: Buying, accepting, possessing or using drugs for personal consumption. For first-time offenders, a suspension path may allow the case to be dropped.

The gap between these two laws is enormous. Art. 188 can mean ten or more years. Art. 191 as a first offence can result in no conviction if the conditions are met.

First-offence personal use: If classified under TCK Art. 191, prosecution may be suspended for five years. If the conditions are fulfilled, the case can be dropped with no conviction.

How Turkey Can Have Jurisdiction When You Are in Germany

You were in Turkey when the incident occurred: Turkey's jurisdiction is clear.

The case was opened before you moved: Leaving Turkey does not close the investigation.

Your name appeared in another investigation: Phone surveillance on another suspect may capture your communications.

Cross-border activity is alleged: Turkey and Germany can both investigate.

If you are planning a trip to Turkey, check your legal status first. An open warrant or default judgment can lead to detention at the airport.

The Airport Scenario

Many people discover an open Turkish case when they try to travel. Turkish border police can see pending warrants and case flags. If flagged, you may be detained, taken to the prosecutor and held in pre-trial detention.

Can You Be Prosecuted in Both Turkey and Germany?

Yes. Germany's BtMG and Turkey's TCK operate independently. Cross-border allegations may produce parallel proceedings.

  • §29 BtMG: up to 5 years or a fine
  • §29a BtMG: 1-15 years
  • §30 BtMG: 2-15 years
  • §30a BtMG: minimum 5 years
  • What is said in one jurisdiction can affect strategy in the other, so coordinated defence matters.

    Defending Yourself from Germany

    Vekaletname: A Turkish power of attorney lets your lawyer access the case file, file motions, attend hearings, challenge detention and file appeals.

    CMK Art. 196: Turkish procedure allows represented defendants abroad to proceed through counsel in suitable cases.

    Default judgment risk: If you ignore the case, Turkish courts can issue a Gıyabi Karar. Once final, it can lead to arrest at the Turkish border.
